Kelly Park Homeowners Association

RULES AND REGULATIONS

One of the primary purposes of a homeowners association it to protect both the quality of the living environment and the value of homes in the association by maintaining architectural standards and setting several rules of conduct. General standards are specified in the official Covenants, Conditions and Restrictions. The following paragraphs outline specific applications of those standards. While the Covenants, Conditions and Restrictions may not change without approval of 75 percent of the owners, many of the specific rules and regulations may be modified from time to time by vote of the board of directors, or by changes in city, state, or federal law.

The exterior of each individual dwelling and the front yard is under the jurisdiction of the KELLY PARK HOMEOWNERS ASSOCIATION.

Therefore: Each homeowner is responsible to maintain the front landscaping so as to achieve an over-all, well-manicured look at Kelly Park. This will include: Mow, edge, water, weed, fertilize and apply insect spray as required to maintain a thick, healthy green lawn.

Before making any change to the exterior of any residence, or to any part of the yard that is visible from the street, the owner must file an application with the Homeowner's association.

A. All complaints, suggestions and/or recommendations must be in writing and signed with house number and phone number before being submitted to the Board of Directors.

B. Board Meetings: The Board of Directors usually meets on the third Thursday of every month at the clubhouse. Confirm actual meeting date on the home page of this website or by phoning Community Karen at Property Management Management at (805-987-8945). The meeting begins at 7:00 PM. The first half-hour will be an open period for discussion between homeowners and the Board.

C. Garage doors should be closed when not in use.

D. Noise, excessive, such as made by stereos and musical instruments, is prohibited.

E. Environment: Please help keep Kelly Park clean by picking up debris you see around area.

F. Yards -- It is the responsibility of the homeowner to maintain a well-maintained and attractive front yard. Any changes to the front yard, such as adding or removing steps, walkways, planters, fences, trees, rocks or bricks, require approval in advance by the Kelly Park Homeowners Association Architectural Committee or board.

 G. Antennas and Dishes -- The CC&Rs forbid any external antennas, but they were written before shall dishes became available. For that reason the board voted that small dishes (under one meter) are acceptable under certain conditions.  J. Windows -- Homeowners who wish to replace the windows in their homes must submit a request for approval from the Homeowners Association board. The board has approved all recent requests for vinyl, double-pane windows.

M. Fences -- Fences next to Kelly Park common areas are owned by the HOA and will be maintained, repaired and replaced by the association as needed. Fences that are not next to common areas, such as those separating most back yards, are the responsibility of the homeowners on both sides of the fence. The cost of all repairs, maintenance and replacement of such fences should be divided equally between the adjoining property owners.

O. Driveways -- must be clean and must not have any foreign objects on them such as pans, boards or trays to catch dripping oil. Drip pans or spots will result in fines.

P. Sidewalks -- All sidewalks along the streets in Kelly Park are city property. No homeowner may obstruct the sidewalks, alter them, or erect anything on them without a permit from the City of Thousand Oaks. Federal, state and city laws requires that all public residential sidewalks provide a minimum of four feet (48 inches) of unobstructed width. If the unobstructed width of any sidewalk in front of any home in Kelly Park is less than 48 inches due to such owner-controlled elements as plants, landscaping or wide mailbox supports, the homeowner will be subject to fines from the Homeowners Association.

Q. Trash Containers and Trash Pick Up: The City of Thousand Oaks provides containers-- Green for general trash or garbage, blue for recycling, and brown for plants and cuttings. No other containers will be picked up, and nothing will be picked up that is not in those containers. All trash in Kelly Park is collected on Wednesday morning, beginning at 7 AM. Full containers may be put out by street no earlier than Tuesday evening, and must be brought in no later that Wednesday night. Outside of those hours, no trash containers may be visible from the street. Trash containers should be placed at least 2-feet from each other to allow the mechanical arm on the trash truck room to grasp the container.

G. Garages may be used only for storing automobiles, towed vehicles, etc. Using garages for bedrooms or living areas is forbidden be both city laws and Homeowners Association CC&Rs.
