Kelly Park Homeowners Association RENTAL PROPERTY If your unit is ever rented or leased for any period of time, a Tenant Abidance Form must be completed, signed and returned to the AMS office. This is necessary so that we know who is living in your unit and which automobiles belong to them. Also it confirms that you have provided your tenants with copies of the Association's Rules and Regulations, to which the will be obligated to adhere. You must fill out this form and return it within 10 days of renting or leasing your property. A. Those Homeowners who choose to rent or lease their property will be required to comply with the following: 1. Notify the Kelly
Park Board of Directors in writing within 30 days. B. All owners who rent their units must abide by the following rules: 1. Provide tenants with copies of CC&R's, By-Laws and Association Rules and Regulations prior to moving in. 2. Any lease or rental agreement shall include the following language: "The terms of this agreement are subject in all aspects to the provisions of the Declaration of Covenants, Conditions and Restrictions (CC&R's) , By-Laws, and the Association rules. Any failure .by the lessee to comply with the terms of such documents may result in a default under the lease. THE UNDERSIGNED, AS LESSEE OR TENANT, ACKNOWLEDGES THAT HE IS FAMILIAR WITH ALL SAID RESTRICTIONS AND RULES OF THE ASSOCIATION AND AGREES TO ABIDE BY THEM. " 3. No tenancy is valid until the Association receives a copy or rental agreement. 4. The wording of this lease can be used by the owner as proof to tenant of promise to obey the Rules and Regulations, should the Board of Directors find it necessary to fine the owner for violations of he Rules and Regulations by a tenant; and may assist the owner in recouping from tenant money paid as fines. 5. No tenant may sub-lease all or part of the rental unit. Owner is responsible for enforcing this rule. C. Yards of
tenant-occupied property comprise the majority of landscaping problems in
Kelly Park. Owners will be held responsible to see that their yards are up
to Kelly Park standards.
