Kelly Park Homeowners Association

POOL RULES

Revised: January 8, 2008

  1. All persons using the pool or spa must abide by the published rules. Failure to comply with any of these rules may result in fines or suspension of pool privileges.
  2. The hours for use of the pool and spa are 8:00 a.m. through 10:00 p.m. Residents or guests inside the pool area after 10:15 p.m. are subject to fine and/or cancellation of pool privileges. Pool privileges will be cancelled for anyone climbing over the fence or onto the clubhouse roof at any time, in addition to charges for damage to the roof or solar panels.
  3. The pool is never furnished with a lifeguard, so it is the responsibility of the homeowners to supervise their own children at all times. Children under 14 years old should be accompanied and supervised by an adult 18 years or older at all times when in pool area; they will otherwise be asked to leave.
  4. For health reasons, the Board has been advised not to allow any children under the age of 10 years into the spa.
  5. All rafts and other floating equipment, with the exception of life preservers, shall be prohibited.
  6. No one group will be allowed to monopolize the pool or spa in any manner that does not respect the rights of others.
  7. No smoking is allowed in the enclosed pool area.
  8. No alcoholic beverages are allowed in the enclosed pool area.
  9. No food or snacks are allowed in the enclosed pool area, with the exception of water and non-alcoholic drinks.
  10. No GLASS CONTAINERS OR PRODUCTS are allowed in the enclosed pool area.
  11. All trash must be deposited in the proper receptacles.
  12. No confetti or balloons are allowed in the enclosed pool area because they clog the pool filters and may ruin the pumps.
  13. Pool furniture is not to be removed from the pool area, nor placed in the pool, spa, or restrooms.
  14. Owners may utilize their own chairs or lounges in the enclosed pool area.
  15. There is no reserving of HOA pool chairs or lounges. Any HOA lounge or chair unoccupied in excess of 30 minutes shall be considered available for use by any resident.
  16. Guests must be accompanied by a resident or owner. Homeowners are responsible for the behavior of their guests or tenants and for any fines, violations or damages incurred.
  17. Guests shall be limited to four per household at any given time, in addition to the hosting residents of Kelly Park HOA. Residents wishing to host a group of more than four guests should apply to the Board for special permission.
  18. The gate must never be propped open, or the lock disabled, at any time. Before entering or exiting the pool area, residents should make sure the gate is locked, then use their own key to open the gate.
  19. Animals are not allowed in the enclosed pool area.
  20. No amplified music (including radios and boom boxes) is allowed in the pool area except by special permission of the Board in conjunction with a special event in the clubhouse.
  21. Running, pushing, cannon-balling and other forms of horseplay will not be tolerated.
  22. Proper bathing attire is required. No cut-offs are allowed.
  23. Diaper-wearing children and incontinent adults must wear swim diapers/underwear when using the pool and spa

Card Keys

  1. One card key to the pool and spa is issued to each homeowner at the close of escrow after deposit of $50 is paid to Kelly Park HOA. This card key is very valuable and should never be loaned to anyone, whether another homeowner or a guest. The homeowner to whom a key is issued will be held responsible for any fines, violations or damages incurred by anyone using the homeownerÕs key card. A homeowner who rents a home in Kelly Park HOA may loan the card key to the tenants of the house, but the homeowner will be responsible for fines, violations and damages. It will be the responsibility of the homeowner, not the HOA, to recover such fines and other costs from the tenants.
  2. Lost keys will be replaced at a cost of $50.00. Application for such replacement may be made at any Board meeting or by calling the Kelly Park Homeowners Association office (where monthly HOA dues payments are generated). Replacement keys will be issued to the homeowner only. NOTE: Each card is numbered and cannot be duplicated. If the card key is lost, contact the Kelly Park Homeowners Association office immediately so your card can be deactivated to minimize your liability for damages or fines resulting from someone else using your key.
  3. Periodically, you may be asked to show your card to identify yourself. This is done for the security of all homeowners. Your cooperation and understanding will be appreciated.
  4. Any HOA Board member or designated pool guard has the authority to enforce pool rules and can have the card key deactivated if a resident or a guest is not obeying the rules.
