Dogs in Kelly Park
Poorly trained or supervised dogs are the most common
complaint from residents in Kelly Park. Every resident who has a dog is urged to obey all
laws and do everything possible to make sure the dog that brings you
pleasure does not impose on your neighbors.
Thousand Oaks City laws require
that dogs not bark "excessively," that dogs be on leashes when
walked, and that owners pick up after their dogs and put any waste materials
in proper trash containers. If you are concerned because another resident is
not following these ordinances you should take the following actions, in
this order.
1. Talk to the dog's owner. Many
problems can be resolved quickly and easily without involving the City or
the Homeowners Association.
2. If the owner refuses to comply,
report the problem to Sgt. Denise Rosen at the City of Thousand Oaks. Phone:

3. If neither of the above actions
solves the problem, report the problem to the Homeowners Association, which
will investigate the situation, and will levy fines on the offending party
if necessary.
REGULATIONS
In 1992 the City of Thousand Oaks adopted Title X (ten), the animal control
laws of Los Angeles City/County. That year the City of Thousand Oaks also
contracted with Los Angeles City/County to provide animal control services
from the LA facility in Agoura Hills. The City of Thousand Oaks says it is
not necessary to know all these laws--just call 818-991-0071, and they will
assist with problems. But for those of you who like to read fine print, here are the laws, anyway:
1. Barking. 10.40.065 PUBLIC NUISANCE
A. Any animal (or animals} which molest passersby or passing
vehicles, attack other animals, trespass on school grounds, is repeatedly at
large, damages and or trespasses on private or public property, barks,
whines or howls in an excessive, continuous or untimely fashion shall be
considered a public nuisance.
B. Every person who maintains, permits or allows a public nuisance to
exist upon his or her property or premises, and every person occupying or
leasing the property or premises of another and who maintains, permits or
allows a public nuisance as described above to exist thereon, after
reasonable notice in writing from the Department of Animal Care and control
has been served upon such person to cease such nuisance, is guilty of a
misdemeanor. The existence of such nuisance for each and every day after the
service of such notice shall be deemed a separate and distinct offense. (Ord.

Complaints from citizens will be investigated by
Animal Control officers. Citizens may request an Animal Noise Complaint Form
from the Agoura Animal Shelter by calling (toll-free) (818) 991-0071. They
may also file a complaint by sending a personal letter to the Agoura
Shelter, 29525 Agoura Road, Agoura Hills, CA 91301. Anonymous complaints are
never considered. Complainants are encouraged to discuss their concerns
with the animal owner prior to filing a complaint because situations can
often be rectified at that level. Within several business days after
receiving a complaint, an officer will visit the home of the animal owner,
discuss the situation, offer possible solutions such as the purchase of a
"bark collar," and deliver a Notice to Abate which gives the owner 15 days
to correct the problem. If problem persists, the complainant needs to notify
the shelter. A petition form will be mailed to the complainant for acquiring
signatures of other neighbors also bothered by the barking and willing to
appear in court (as explained on the petition form). Upon return of the
petition form from the complainant, Animal Control will work with the City
Attorney’s Office concerning further steps to be taken. These may include
the issuance of a citation to the animal owner which will require his
appearance in court and the possible payment of fines.
2.
Leash Law: 10.32.010 DOGS--RUNNING AT LARGE PROHIBITED
No person owning or having charge, care, custody or control of any dog shall
cause, permit or allow the same to be, or to run at large upon, any
highway, street, lane, alley, court or other public place, or upon any
private property or premises other than those of the person owning or having
charge, care, custody or control of such dog...unless such dog be restrained by a substantial
chain or leash not exceeding six feet in length and is in the charge, care,
custody, or control of a competent person. (Ord. 9454 1 (part), 1967: Ord.

Pooping: 110.40.060 ANIMAL NUISANCES PROHIBITED WHERE.
A. A person having custody of any dog or animal shall not permit,
either willfully or through failure to exercise due care or control, any
such dog or animal to commit any nuisance upon the sidewalk of any
public highway or upon the floor of any common hall in any apartment house,
tenement house, hotel, or other multiple dwelling or upon any entranceway,
stairway or wall immediately abutting on a public sidewalk or upon the floor
of any theater, shop, store, office building or other building used in
common by the public or upon the floor or stairway of any depot or station
or public waiting room or upon the floor, stairway, entranceway, office,
lobby or patio used in common by the public or without consent of the owner
or person in lawful occupation thereof, any lawn, yard, or any other private
property whatever, which is either improved or occupied.
B. It is unlawful for the owner or person having custody of any dog
or other animal to permit, either willfully or through failure to exercise
due care or control, any such dog or animal to commit any nuisance and to
allow such nuisance to thereafter remain upon any public or private property
not owned or possessed by the owner or person in control of said animal,
provided that the person who owns, harbors, keeps or has charge or control
of a dog (other than a sightless person who has charge or control of a guide
dog} shall immediately and securely enclose all feces deposited by such dog
in a bag, wrapper or other container and dispose of the same in a sanitary
manner. Any person (other than a sightless person with a guide dog} who has
charge or control of a dog in a location other than on the property of such
person or the property of the owner of the dog, shall have in his or her
possession a suitable wrapper, bag or container (other than articles of
personal clothing) for the purpose of complying with the requirements of
this section. Failure of such person to carry such wrapper, bag or container
when in charge or control of a dog in a location other than on property of
such person or the property of the owner of the dog or animal shall
constitute a violation of this section.
C. For the purpose of this section a "nuisance" committed by a dog or
animal shall mean defecation by said animal. (Ord. 85-020423, 1985: Ord.
